Writing for the Supreme Court, then-Justice Gildea held that the State Building Code preempted stricter local standards regarding ground fault interrupter receptacles, bathroom ventilation, and egress window covers.
The Supreme Court returned the case to the trial court to develop the records regarding the Morris ordinance and whether the ordinance provision regulating smoke detectors in sleeping rooms is prohibited by state law.
